LAST WILL AND TESTAMENT
STEPHEN MANFULL 1781-1864

IN THE NAME OF THE BENEVOLENT FATHER OF ALL:

I, Stephen Manfull of Augusta, Carroll County, Ohio, do make and publish this my last will and testament:

ITEM 1st: It is my will that all my just debts be paid.

ITEM 2nd: I give and bequeath to my son, Charles Manfull, the lot of ground bounded on the south by the lot of John W. Grimes; said lot extending east to the west line of the lands of George Manfull.

ITEM 3rd: It is my will, that at my death there be an appraisement of all the chattels and personal property on my farm or otherwise, and such personal property and chattels as at that time belong to and are attached to the farm are to be for the use and benefit of my son, Charles Manfull, for the period of two years from my death, but the chattels and personal property on the farm at my death are not to be sold nor dispersed of by my son, Charles, but to have the use of the same, together with the farm for the above period of two years from my decease.

ITEM 4: It is my will that at my death or rather at two years after my death the land together with the personal property be sold; the manner of the sale of the land as follows, to wit, forty acres in one lot and the other lot containing about twelve acres including the dwelling house to be sold separately. The proceeds of said sales with all the other effects to be distributed as follows:

ITEM 5: I give and bequeath to my grandson, George Manfull, son of Charles Manfull, one hundred dollars.

ITEM 6: I give and bequeath to my grandson, Stephen Manfull, son of Charles Manfull, fifty dollars.

ITEM 7: The balance of the proceeds of all my estate both real and personal, it is my will, is to be divided equally among the following named persons to wit, my sons, John Manfull, Thomas C. Manfull, Charles Manfull, Wm S. Manfull; my daughters Mary Jackson, Louisa Fisher, Elisabeth Ashton and Francis Ashton, and my granddaughter, Elisabeth A. Millbourn, daughter of my son, Stephen Manfull, deceased.

ITEM 8: I ALSO HEREBY NOMINATE AND APPOINT MY SON, John Manfull, and Thomas Kinsey , executors of this my last will and testament, hereby authorizing and empowering them to compromise, adjust, release and discharge, in such manner as they may deem proper, the debts and claims due me, and to do and perform every and all the requirements of this my last will and testament.

I desire that no appraisement and no sale of my real and personal
property be made, other than directed in this last will and testament. It is my will that the court of probate require no bail from the executors. I do hereby revoke all former wills by me made.

In testimony whereof I have hereunto set my hand and seal, this 1st
day of January, A.D. 1860.

CODICIL
STEPHEN MANFULL
DATED JULY 23, 1861

Item 1st: The appraisement referred to in Item 3 of all my personal property and effects shall be made by my two Executors, John Manfull and Thomas Kinsey, without the asst. of other appraisers. The use of the chattel property after appraisement together with the use of the farm for two years after my death to my son, Charles Manfull, is not to be transferred-he alone to occupy the same and be accountable to the executors aforesaid.

2nd: The sale of all my real and personal estate may be concluded by Executors without appraisement provided that all my heirs can agree to make the purchaser a quit claim deed for the same.

In testimony whereof I have hereunto set my hand and Seal this 23rd day of July A.D. 1861.
